TERMS OF USE

1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the Nia Career Counselling & Consulting website (www.niaonline.com.au) and all services provided by Nia, operated by Vicki (ABN: 28 511 430 171), Victoria, Australia ("Nia", "we", "us", "our").
By accessing our website, booking a session, or engaging with our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
2. Our Services
NIA provides private online career counselling and consulting services including:
• 1:1 career counselling sessions (60 minutes, conducted via video call)
• Online career assessment packages (including assessments, plus a 60-minute debrief session and written report)
All services are delivered online to clients across Australia. Nia reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice.
3. Eligibility
Our services are intended for individuals aged 18 years and over. By booking a session, you confirm that you are at least 18 years of age. Nia primarily works with white collar professionals aged 21 to 60, though we welcome enquiries from individuals outside this range.
4. Nature of Services — Important Disclaimer
Nia provides career counselling and consulting services. While Vicki holds qualifications in counselling, rehabilitation, and mental health, Nia's services are focused on career development and professional identity, and do not constitute clinical mental health treatment, psychological therapy, or medical advice.

5. Bookings and Appointments
All appointments are booked through our online booking system (Carepatreon). By making a booking, you agree to:
• Provide accurate and complete information at the time of booking
• Attend your session at the scheduled time via the video platform specified
• Notify us as soon as possible if you are unable to attend a scheduled session
6. Cancellation Policy
Nia does not charge cancellation fees. We understand that circumstances change and that life can be unpredictable. If you need to cancel or reschedule an appointment, we ask that you:
• Provide as much notice as possible — ideally at least 24 hours before your scheduled session
• Contact us by email at hello@niaonline.com.au or through your Carepatreon booking confirmation
While there are no cancellation fees, repeated late cancellations or non-attendance may affect our ability to accommodate future bookings.
7. Payments
Payment for services is processed securely via Stripe. By providing your payment details, you authorise Nia to charge the agreed amount for the service booked. All prices are in Australian Dollars (AUD) and include GST where applicable.

Payments are processed at the time of booking or as otherwise agreed. Receipts will be provided via email following successful payment.
8. Use of AI Note-Taking — Heidi
Nia uses Heidi, an AI-powered clinical note-taking tool, to assist with the documentation of session content. This tool helps ensure accurate and thorough session records.
• You will be notified before any session in which Heidi is used
• Your consent will be obtained prior to use
• You may opt out of AI note-taking at any time without affecting your access to our services
• Notes generated by Heidi are reviewed by Vicki and form part of your confidential client record
9. Confidentiality
Nia is committed to maintaining strict confidentiality. All information shared during sessions is kept confidential, except in the following circumstances required or permitted by law:
• Where there is a risk of harm to yourself or another person
• Where we are required to disclose information by a court of law or other legal obligation
• Where you have provided explicit written consent for disclosure
Confidentiality obligations also apply to our use of third-party platforms (Carepatreon, Heidi, Stripe) — these providers are bound by their own privacy and confidentiality obligations.
10. Online Session Requirements
To participate in online sessions, you are responsible for:
• Having a stable internet connection
• Using a device with a functioning camera and microphone
• Being in a private, quiet environment conducive to the session
• Downloading or accessing the video platform specified in your booking confirmation
NIA is not responsible for technical difficulties on your end that result in a disrupted session. Where a session is significantly disrupted due to technical issues on our end, we will arrange a replacement session at no additional cost.
11. Intellectual Property
All content on the Nia website — including text, graphics, logos, and materials — is the property of Nia Career Counselling & Consulting and is protected by Australian copyright law. You may not reproduce, distribute, or use any content from our website without prior written permission.
Assessment reports and written materials provided to you as part of our services are for your personal use only and may not be shared, reproduced, or published without our consent.
12. Limitation of Liability
To the maximum extent permitted by law, Nia shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of our services or website. Our total liability to you for any claim arising from these Terms or our services is limited to the amount paid by you for the specific service in question.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law.
13. Website Use
You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
• Use our website in any way that causes, or may cause, damage to the website or impairment of its availability
• Transmit any unsolicited or unauthorised advertising or promotional material
• Attempt to gain unauthorised access to any part of our website or systems
14. External Links
Our website may contain links to third-party websites. These links are provided for your convenience only. Nia has no control over the content of those sites and accepts no responsibility for them.
15. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of Victoria.
16. Changes to These Terms
We reserve the right to update these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Your continued use of our services following any update constitutes acceptance of the revised Terms.
